Please read these Customer Terms and Conditions carefully before ordering any products.  By ordering any of the products or services from the Beyond Measure website, you agree to be bound by these Customer Terms and Conditions. You will need to tick the box marked “I have read and agree to Customer Terms and Conditions” if you accept them, otherwise you will not be able to order products from our website.

The contract between us

We must receive payment of the whole of the price for the products that you order before your order can be accepted. Payment of the price for the products represents an offer on your part to purchase the products, which will be accepted by us only when the products are dispatched. Only at this point is a legally binding contract created between us.

Prices and Payment

All prices displayed are in Pounds Stirling an inclusive of any VAT. All prices are correct at the time of entering information. You may purchase products displayed on the website through the secure online payment system Shopify Payments, which operates through Stripe or Paypal. Beyond Measure does not store your credit / debit card details.  If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us through Stripe or Paypal, we will not be liable for any delay or non-delivery of your order.

We reserve the right not to process your order if:

  • We have insufficient stock to deliver the products you have ordered.
  • We do not deliver to your area.
  • One or more of the products you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do not process your order for the above reasons, we will notify you by e-mail and will refund any sum deducted by us via Stripe or PayPal as soon as possible, but in any event within 14 days.

Acknowledgement of your order

To enable us to process your order, you will need to provide us with your e-mail and postal address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us.

Accuracy of content

We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all products have been described accurately. However, orders will only be processed if there are no material errors in the description of the products or their prices as advertised on this website. Many of the items are made by hand and not mass-produced. Therefore slight variations in design and colour are always possible. We will try to represent each product as accurately as possible on our website but there may be some inaccuracies due to photographic reproductions or screen calibration.  Measurements are given where appropriate but please do contact us if you need a particular measurement that is not stated.

Availability

All orders are subject to acceptance and availability. If the products you have ordered are not available from stock, we will contact you by e-mail or phone. You will have the option either to wait until the item is available from stock or to cancel your order and receive a refund.

Delivery methods, charges and times

We will notify you by e-mail when your order has been dispatched. Delivery is by Royal Mail unless stated otherwise.  Current delivery charges and times can be viewed on our Delivery Page.  If you require a different shipping method or tracked delivery, please contact us and we will try out best to accommodate your needs.  In this instance, any additional cost must be covered by the customer and delivery method and price will be agreed and paid for by the customer before dispatch.

We will deliver the products to the address you specify for delivery in your order. It is important that this address is accurate.  We will aim to deliver the products within 5 – 7 working days for the UK, 14 working days for International sales but delivery times are not guaranteed. In any event, we will aim to deliver your products within 30 days from the day after the day we received your order. If delivery is delayed beyond this time, we will contact you and either agree a mutually acceptable alternative date, or offer you a full refund.

If no-one is in to receive your delivery from Royal Mail or from other delivery services, a card may be left and your delivery may be taken to a depot for collection by you or re-delivery attempts made.  It is your responsibility to follow the instructions left by Royal Mail or the delivery company in order to take receipt of your package.  If the package is not collected and then returned to us, we will process a refund of the products minus postage within 14 days of receiving them.

If you indicate that a parcel can be left at your home or with a neighbour, this is at your own risk. Some couriers do not like to leave parcels unless signed for by the customer, so we cannot guarantee delivery if you are unable to receive the parcel yourself.

International shipping

We offer tracked International Shipping via Royal Mail.  However, a fully tracked service may not be offered from dispatch to delivery point in all countries, so we reserve the right to chose the best possible option for your parcel and may need to take further payment from you if we need to upgrade your service or send multiple or large packages to accomodate your order.  We will contact you if we need to do this and before we dispatch your order.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase products from our site. 

You, the customer, may be liable for payment of customs, import taxes and handling fees as the goods enter your country and to enable release of your parcel from customs.  These fees will vary from country to country and Beyond Measure will not be liable for prediction or payment any of these fees.

The importation or exportation of certain of our products to you may be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the products you purchase.

Ownership of goods

You will become the owner of the products you have ordered when they have been delivered to you. If you choose to use your own courier then the risk passes to you as soon as the products are handed to your courier. Once products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Contract cancellation, returns and refunds

We hope that you’ll be very happy with your purchases from Beyond Measure but understand that occasionally you may wish to return an item and seek a refund.

You cannot cancel your contract if the products you have ordered are bespoke (i.e. made to order), personalised or cut to size (i.e. fabric or ribbon)

If you wish to cancel your order prior to dispatch, please contact us as soon as possible with your order number and we will arrange a refund.

If you cancel your order but we have already dispatched the products for delivery, you should not unpack the products when they are received by you and you must send the products back to us at our contact address at your own cost and risk as soon as possible.

If you have received your order and wish to return any item/s, you are entitled to cancel your purchase, provided you do so no longer than fourteen days after the day on which you receive the products. You need to let us know in writing no longer than fourteen days after the date on which you received the products. Please email us at grace@shopbeyonmeasure.co.uk with your contact details, your order number and let us know why you are returning an item/s so that we can put things right for you. The item/s must be returned to the returns address on your delivery note at your own cost and risk. Your item/s must be returned in good condition in original packaging within fourteen working days from the date on which you cancelled your order in writing.

If you are returning an unwanted or unsuitable product, you are liable for the return cost of postage.  If you return product to us, please use an insured method of delivery and obtain proof of posting. We cannot accept liability or offer refunds for returned products that are lost or damaged in transit.  A deduction can be made if the value of the products has been reduced as a result of the products being handled more than necessary.

You’ll be given a refund of the price of the product/s and the lowest delivery charge offered at purchase within 14 days of you dispatching the goods.  If you have bought more than one item and keep one or more items, we will only refund the cost of the returned product and not refund any postage costs.  We will refund any money received from you using the same method originally used by you to pay for your purchase.

Faulty/damaged products

On receiving your products you must inspect the products immediately upon receipt and must notify us in writing at grace@shopbeyondmeasure.co.uk as soon as possible if products are damaged or faulty.  If you fail to return the products within 14 days of notifying us then you will be deemed to have fully accepted the products.

If the products are damaged or faulty, you must return the products to Beyond Measure at the address supplied. You will be entitled to receive a full refund, including the lowest delivery cost offered at purchase, plus the cost of returning the products.   We will process refunds using the same method originally used by you to pay for your purchase.

If returned products are found to be damaged and this is found to be the fault of the buyer, we will not be able to offer a refund.

Liability

We only supply the products for domestic and private use.  

We do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Beyond Measure. Any use of this website or its contents, including modifying, copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission.

Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through before you make an order.

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

Third party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
